Clarification Of Level I And Level II Skill Levels For The Purposes Of Prevailing Wage Determinations

Q's & A's Regarding Level I and Level II designations in the Employment Certification Program.

In response to an increasingly competitive world economy, the 1990 Immigration Act expanded the number of skilled and professional foreign workers who could be employed under permanent and temporary visas. The work applications and processing were delegated to the states by the U.S. Department of Labor, Employment and Training Administration. H-1B visas are temporary visas (up to 3 years) for various professional occupations. The majority of the professional occupations are computer-related or engineering occupations.

The H-1B category of specialty occupations consists of those occupations which require the theoretical and practical application of a body of highly specialized knowledge and the attainment of a bachelor's or higher degree (or its equivalent) in the specific specialty as a minimum for entry into the occupation in the United States.

One aspect of granting a visa requires determining if the wage the employer intends to pay the alien meets the prevailing wage for that occupation in the geographic area in which the alien will be employed. The prevailing wage determinations are completed by the Labor Certification Unit of the Colorado Department of Labor and Employment. The process of establishing the prevailing wage is as follows:

The completed Prevailing Wage Request form is faxed to the Labor Certification Unit at  303-318-8930  or can be e-mailed by clicking the link at the top of this page, from employers or their agent attorneys, logged in, and given to the prevailing wage specialist for processing.

Based on the job described, a Dictionary of Occupational Titles (DOT) occupational code is assigned. The U.S. Department of Labor's Fourth Edition, Revised 1991 is used.

A prevailing wage determination is made utilizing the Occupational Employment Statistics/Alien Labor Certification (OES/ALC) survey unless a wage determination under the Davis-Bacon Act, the Service Contract Act, or a collective bargaining agreement applies.

The wage determination and related information are entered on the bottom of the Prevailing Wage Request form and faxed/e-mailed back to the requesting employer or agent. Requests are handled within 15 working days.

Note:
When completing item 11 (job duties) of the Colorado Prevailing Wage Form, the following skill levels will be used in determining the prevailing wage.

Skill Level I -- Beginning level employees having a basic understanding of the occupation through education or experience. They perform routine or moderately complex tasks that require limited exercise of judgement and provide experience and familiarization with the employer's methods, practices, and programs. They may assist staff performing tasks requiring skills equivalent to a level II and may perform higher level work for training and developmental purposes. These employees work under close supervision and receive specific instructions on required tasks and results expected. Work is closely monitored and reviewed for accuracy.

Skill Level II -- Fully competent employees who have sufficient experience in the occupation to plan and conduct work requiring judgement and the independent evaluation, selection, modification, and application of standard procedures and techniques. Such employees use advanced skills and diversified knowledge to solve unusual and complex problems. They may supervise or provide direction to staff performing tasks requiring skills equivalent to a level I. These employees receive only technical guidance and their work is reviewed for application of sound judgement and effectiveness in meeting the establishment's procedures and expectations.
